Welcome to our online platform. This website is owned and operated by JIA Active. Throughout the site, the terms “we”, “us” and “our” refer to the brand.

1. AGREEMENT TO TERMS

By accessing or using the JIA Active website, you agree to be legally bound by these Terms of Service. Please read them carefully before placing an order. If you do not agree to these Terms, you should not use our website or place an order.

Nothing in these Terms affects your statutory rights under UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you. Your data is stored through Shopify’s data storage, databases, and the general Shopify application in accordance with our Privacy Policy.

2. PRODUCTS & PRICING

All prices displayed on our website are in British Pounds (GBP) and are inclusive of UK Value Added Tax (VAT) where applicable. Shipping costs are calculated and displayed additionally at checkout.

We reserve the right to modify prices, discontinue products, or change specifications at any time without prior notice. However, you will always be charged the price displayed at the exact time your order was successfully completed.

In the event of an obvious technical or pricing error on the storefront, we are under no obligation to provide the product to you at the incorrect lower price. We will contact you before processing your order to give you the option to proceed at the correct price or cancel your transaction for a full refund.

Product images are for illustrative purposes only. While we aim to display fabric weaves, technical features, and colours accurately, digital display screens vary; we cannot guarantee that your device’s display will reflect the exact product colour.

All products are subject to stock availability. Because the platform processes simultaneous transactions, an item added to your cart is not reserved and may be purchased by another customer before your checkout is fully processed.

3. ORDERS & PAYMENT

By placing an electronic order, you confirm that all information provided is accurate, complete, and that you are authorised to use the payment method provided.

Payment is authorised and captured at the time the order is placed through our secure third-party Shopify Payment gateways. We accept major credit/debit cards, Apple Pay, PayPal, and any other digital wallets explicitly displayed at checkout.

Orders are not legally confirmed until you receive a shipping or order confirmation email containing tracking details. This step forms a binding sales contract between you and JIA Active under UK distance selling rules.

We reserve the statutory right to refuse, limit, or cancel any order at our sole discretion. This includes orders flagged by Shopify’s automated fraud and risk-analysis systems, orders that appear to be placed by dealers, resellers, or distributors, or orders with unavailable stock. If an order is cancelled or modified after payment has been captured, a full refund will be issued immediately to the original payment method.

4. DELIVERY OF GOODS

All delivery timeframes are estimates only and are not guaranteed.

We are not responsible for delivery delays entirely outside our reasonable control, including courier distribution issues, customs processing delays, or unforeseen circumstances.

Risk in the goods (including risk of loss or damage) passes directly to you once the package has been successfully delivered to the physical shipping address or designated safe-place provided by you during checkout.

5. RETURNS, REFUNDS & CANCELLATIONS

All returns and cancellations are governed directly by our separate Returns Policy, which is incorporated into these Terms by reference.

No Exchanges: We do not offer direct exchanges for online purchases. If you require a different size, colour, or alternative style, you must return your original unwanted item for a refund in accordance with our Returns Policy and place a new, separate order through the website for the replacement item.

Nothing in these Terms limits your statutory rights to return faulty, misdescribed, or defective goods under the Consumer Rights Act 2015, or your right to cancel an online order within 14 days of receipt under the Consumer Contracts Regulations 2013.

6. INTELLECTUAL PROPERTY

All content on this website — including but not limited to images, text, graphics, lookbooks, custom logos, product designs, activewear patterns, and branding — is the absolute property of JIA Active or its licensors.

This content is protected under UK and International Copyright, Trademark, and Intellectual Property legislation. You may not copy, scrape, reproduce, distribute, or exploit any content without our prior, explicit written permission.

7. PROHIBITED USE

You explicitly agree not to misuse this website or use it for any unlawful or infringing purpose. Prohibited digital conduct includes, but is not limited to:

Using the site for any unlawful purpose or to solicit others to perform unlawful acts.
Attempting to gain unauthorised access to our Shopify host servers, databases, or data networks.
Introducing viruses, malware, worms, or any other type of malicious, destructive, or disabling code.
Using automated systems, bots, spiders, or scrapers to extract data or index pages, or using the website in a way that may damage, impair, or degrade platform performance.

8. LIMITATION OF LIABILITY

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

To the fullest extent permitted by law, JIA Active, our directors, officers, or partners shall not be held liable for any indirect, incidental, or consequential loss, including loss of profit, revenue, or data arising from your use of our service or items procured through the store. Our total liability to you in respect of any order shall not exceed the total amount paid for the relevant goods.

9. GOVERNING LAW & JURISDICTION

These Terms of Service and any separate e-commerce transactions shall be governed exclusively by, and construed strictly in accordance with, the laws of England and Wales.

Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. CHANGES TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
